Attorney for Amish Asking Case Be Transferred

The lawyer representing several Amish men facing building code violations in Morristown wants the judge in the case to step down.

Assistant Public Defender Steven Ballan filed court papers asking the case against 11 Amish men be transferred to another municipal court.

Ballan is hoping the move will allow him to argue his requests to dismiss the charges again.

The Amish men were cited by town officials for building without permits.

According to Ballan, a change in venue will help the men get a fair trial.

    Since July 2nd our blog First Amendment: Inside the Amish Swartzentruber sect http://swartzamish.blogspot.com has had over 800,000 hits in regard to the Swartzentruber Amish.
    In preparation for my upcoming documentary I have collected thousands of pages of information about the Morristown Case.
    While filming the documentary it seems that everyone in Morristown has voiced an opinion about this case and some opinions are quite strong.
    The Amish will never get a fair trial in Morristown as too many people have read, heard, or viewed conflicting reports about this matter.
    The Judge must be living under a rock if he does not grant a change of venue.
    In fact, Judge Phillips has googled his name and is a frequent visitor to my blog, Kay Davis has hit my blog atleast 220 times in 1 day!
    It seems that they want to see what is written about themselves.
    Some people are just outright prejudiced and they do not understand their neighbors.
    Morristown does not have adequate parking for a long trial. They don’t have hitching posts for the horses, and an adequate water supply for them.
    But Lewis County provides this for their Amish.
    I guess the only place the Amish will get a fair trial is any place where their is no Amish.
